Generative AI has taken the world by storm and quickly being integrated in all kinds of ad creation and campaign platforms. But while the use of AI has expanded in the general context, people are calling for regulation.

Various organizations are currently trying to establish legal copyright pertaining to the use of generative AI to help them find a direction as they move forward.

As of now, individuals and brands have access to the use of generative AI content for any and all purposes. All they need to do is create it using evolving systems of AI.

Thus, in technical terms, the creator of an asset or some content is someone who entered the query. In the legal context, this is because the content did not exist before the prompt was typed by the user.

However, this definition of a creator is currently being disputed.

On the other hand, according to the US Copyright Office, it is impossible to copyright any issues arising from the use of AI. It said that a form or presence of human authorship is required to create a provision of this kind.

Therefore, it is possible that neither the user typing in the prompt, nor the generative AI are users in this situation. As per the US Copyright Office, issues like these are no less than legal minefields.

A number of artists are currently pushing for a change in legal provisions in order to protect their patented works. The music industry has also now entered the mix, which is heavily litigated.

This occurred soon after Drake used generative AI to create a track online and gained significant notoriety across the globe.

This prompted the National Music Publishers Association to issue an open letter, which called on the Congress to reevaluate the legality of permitting AI models to create assets based on the work of humans.

The AI-generated track released by Drake sounds like the singer himself and encroaches his copyright, which is his style and distinct voice. Without these two factors, it is highly likely that the song would not have gained as much traction as it did.

According to numerous legal experts, there does seem to be legal basis in cases of generative AI, as well as in the case of Drake. However, the law has yet to catch up on these new tools.

Currently, there is no definitive and appropriate legal instrument, which could prevent people from creating content or assets and profiting off the work of AI.

Even if their work becomes derivative, people all over the world are using AI for their individual causes.

In addition, AI-generative images are causing much misunderstanding and miscommunication. This is due to the convincing pictures that it is able to produce when a user types in a prompt.

Such images have been convincing to an extent that they have affected stock prices and left people confused.

For example, a user asked generative AI for a picture of Pope wearing a puffer jacket. However, many are debating its authenticity online.
